UNUM
Unum Provident is one of the largest providers of group and individual disability insurance throughout the United States. The company sells its disability insurance policies through subsidiaries such as Unum Life Insurance Company, Provident Life & Accident Insurance Company, First Unum Life Insurance Company, Paul Revere Life Insurance Company, and Colonial Life & Accident Insurance Company. Between 1992 and 2002 there have been more than 10,000 lawsuits filed against Unum Provident for denial of claims and mishandling of claims. About Unum Denying Claims Unum had systematically denied insurance claims as a "cost-cutting" effort. Internal documents and deposition testimony allegedly revealed that the insurer focused more on its "bottom line" and denied legitimate claims that should have been paid. The evidence presented allegedly established that since 1995, the insurer engaged in a pattern of both terminating policies after claims were filed and denying legitimate claims by seeking biased reports from biased doctors. In addition, it was noted that Unum destroyed relevant information in claims files, repeatedly misrepresented policy terms and ignored treating physicians' reports of claimants' injuries. Moreover, it has been noted that the insurer had a practice of advising claimants that their claims were covered under ERISA, which limits the remedies that are available to them. Also, they denied claims stating that underwriting guidelines did not call for payment, when in fact the insurer had retroactively changed its own underwriting guidelines and wording of the policies so that they would be more to its own financial benefit.
If you applied for disability benefits from Unum or one of its
subsidiaries between 1997 and 2004 and your claim was denied, you
may still be entitled to benefits. A settlement was reached between
Unum and state and federal regulators whereby the insurer has agreed
to reevaluate more than 218,000 previously denied claims. We at
Daley, DeBofsky and Bryant can help you determine whether or not
your claim is legitimate and should be paid. We have successfully
represented policyholders of Unum and its subsidiaries for many
years. Contact us today for a free initial evaluation at 1-312-372-5200 or via e-mail at
